  11.   Justice Stevens, concurring in part and concurring in
  12. the judgment.
  13.   While I agree with Justice Blackmun's analysis of the
  14. Government's Appropriations Clause argument, and join
  15. his opinion in its entirety, I also agree with The Chief
  16. Justice that 31 U. S. C. 1304, together with 28 U. S. C.
  17. 2465, provide a satisfactory alternative response. 
  18. Moreover, like Justice White, and for the reasons stated
  19. in his separate opinion, I am surprised that the Govern-
  20. ment would make -such a transparently fallacious- argu-
  21. ment in support of its unconscionable position in this case.
